Victims outraged by bizarre let-off

TWO judges sparked fury yesterday by slashing a pervert teacher’s jail term because the pupil he abused took 17 years to complain.

Campaigners said the ruling by Lords Prosser and McCluskey could deter victims from coming forward and put abusers back on the streets.

Teacher Nigel Cartwright repeatedly preyed on a girl pupil, starting when she was 13.

He even had sex with her while a guest in her parents’ home. He was jailed for six years and judge Lord Hardie told him he abused his position of trust.

But Cartwright would only have faced two years in prison if he’d been convicted straight away because sentences in the 80s were shorter.

So the appeal judges cut his punishment to the 80s level, two years.

Astonishingly, it was the judges who suggested the technical argument. They strongly hinted to Cartwright’s counsel that he should look at the law as it stood in the 80s.

They even questioned whether Cartwright should have been convicted at all but his counsel Edgar Prais said he accepted his guilt.

The decision amazed SNP home affairs spokeswoman Roseanna Cunningham, herself a leading lawyer.

She said: “If a murder case from 1964 were solved today, does this mean the killer should hang because we still had the death penalty then?”

Cunningham said the ruling was an appalling insult to abuse victims.

She added: “This sends out very confusing signals. It makes it seem as if abuse from the past is less serious.”

It’s feared the ruling could lead to appeals by perverts like David Murphy, who got 15 years for abusing boys at children’s homes between 1960 and 1986.

Others who could be affected include James Kiers, who abused a young girl in the early 80s.

Even the likes of George Cullen, who molested girls at a care home just before the law was changed in 1997, may harbour hopes of an appeal.

The judges were also condemned by pressure group Scottish Parents Against Child Abuse.

Spokeswoman Pauline Thomson said: “This is 10 steps backwards for the victims. They suffer while the perpetrators get off lightly again.

“How do we persuade victims to come forward now?”

Cartwright, 49, abused the girl when she was a pupil at now-closed Kilquhanity House School in Kirkcudbrightshire.

The school was known for its liberal regime and pupils had sex with each other.

Cartwright had sex with the girl for two years, starting when she was 13. He also had sex with her while staying at her home in the holidays.

The victim kept silent for years before speaking out in 1999 while suffering post-natal depression. She said Cartwright had “stolen part of her childhood”.

She added: “He would invite us all to his room for coffee then send everyone else away but me. He was grooming me, like paedophiles do.”

Lord Hardie said the school’s permissive rules made it even more vital for teachers to protect children.

But Cartwright, of Havant, Hampshire, appealed the length of the jail term.

And after the hint from the bench, Mr Prais argued that the law 20 years ago only allowed a two-year sentence.

Lord McCluskey ruled: “It would be a miscarriage of justice to exceed that period because of the complainer’s deliberate decision to make no report until more than 17 years later.”

Six years for abusing 13-year-old-girl

A PERVERT teacher was slammed for “systematic abuse” of a teenage pupil as he was jailed for six years yesterday.

Disgraced Nigel Cartwright began weekly sex sessions with the girl when she was aged just 13.

And judge Lord Hardie hit out: “She feels that you stole part of her childhood and that is a fair way to put it.

“It was a pattern of abuse over a prolonged period. It is particularly serious because you were in a position of trust.”

The victim, who cannot be named for legal reasons, is now 34 and living in Scandinavia.

She only reported Cartwright – who last month admitted unlawful intercourse – after giving birth and suffering severe post-natal depression

TEACHER abused a 13-year-old girl at a boarding school where staff and pupils swam naked together

Nigel Cartwright, 49, had regular sex sessions with the youngster in his room and in the countryside despite being warned about their relationship.

A police investigation into the abuse at a Scottish school in the early 1980s was launched after the woman, now 34, suffered severe post natal depression following the birth of her son two years ago.

She confided in a friend working for the National Society for the Prevention of Cruelty for Children who advised her to make a complaint.

Cartwright was forced to quit his post at Cottesmore School in Buchan Hill, Pease Pottage, where he had worked for 12 years as a maths and computer teacher, when the revelations came to light.

Yesterday Cottesmore head Mark Rogerson said: On hearing of the allegations against him in April 2000 he immediately offered his resignation which was accepted. All parents were fully informed of the situation.

Nigel Cartwright was an exemplary teacher and was much respected by children, parents and colleagues alike.

Advocate Depute Sean Murphy, prosecuting at the High Court in Kilmarnock on Monday, explained Cartwright had worked at Kilquhanity House School in Castle Douglas, Dumfriesshire.

Youngsters at the school used to go for a chat and coffee to his room but by 1980 the 13-year-old victim was seeing him alone.

Mr Murphy said: On one occasion of her own accord she sat on his knee.

Another time he kissed her on the mouth and the affair developed.

In the term that followed she visited him in his room – the accused was in bed naked when he told her to remove her clothes and she got in bed with him.

Kissing and intimate touching followed.

The court heard the relationship attracted attention and Cartwright was warned by both the head teacher and the head s wife and advised not to encourage anything that might be considered innapropriate .

It was assumed Cartwright was not having sexual relations with the girl but Mr Murphy said: Within weeks the two did consumate the relationship having intercourse in the accused s room.

It became a regular practice for the remainder of the child s time at the school.

Mr Murphy added: One of the customs of the school was that parties of both staff and pupils took part in nude bathing in the river.

On one occasion sexual intercourse took place between them in an area close by.

During the summer holidays in 1980 the girl told Cartwright she thought she was pregnant and he visited her Glasgow home, leaving with a urine sample which proved negative.

On another visit to her parent s home Cartwright and the girl made love.

She left the school in 1982 but the affair continued for another year before the girl broke it off.

Interviewed by Dumfries Police, Cartwright admitted the illicit affair and left his job at Cottesmore after reporting the matter to the school.

Cartwight, of Havant, Hants, admitted shameless indecency and having unlawful sex with a girl.

Judge Lord Hardie ordered him to sign the sex offenders register and released him on bail until Friday, January 26, for sentencing at Edinburgh High Court.

Internet sex pervert is jailed

FORMER primary school teacher Graham Kennedy has been jailed for a sex attack on a 14-year-old boy he groomed via the internet.

Kennedy, 33, of Galway, was later found to have more than 73,000 indecent images of children on a computer, Wolverhampton Crown Court heard.

Judge William Wood, QC, jailed him for three-and-a-half years and also ordered Kennedy to register indefinitely as a sex offender.

The judge told him: “You used chatrooms to make contact with children.”

He said that Kennedy, a married man who lives and works in Birmingham, used the pornographic pictures he downloaded from the internet as a “means of personal gratification”.

He added the ex-teacher, now working as a salesman, had played his part in the abuse of the small children by downloading the images from the net.

Kennedy admitted two charges of indecent assault and 21 of making indecent photographs of a child.

Prosecutor John Evans said Kennedy made contact with his 14-year-old victim through a chatroom and he twice indecently assaulted him after they first met on the car park of a pub.

The boy’s mother became concerned about his behaviour and when she checked his mobile telephone, she found a number of sexual messages, after which Kennedy was arrested.

Children’s home worker jailed

A pensioner has been jailed for eight years for carrying out a string of sex assaults on vulnerable young boys at a Birmingham care home where he worked.

Arthur Birch, 82, of Wisley Way, Quinton, Birmingham was found guilty of seven counts of indecent assault and three of a serious sexual nature at a trial at Birmingham Crown Court in June.

The former Desert Rat soldier, who served in North Africa during WWII, carried out the abuse at the Tennal Assessment Centre in Harborne, in the 1970s and 1980s.

His co-accused, 79-year-old Eugene Devoti, was jailed for seven years in September after he had been found guilty of five indecent assaults at the centre.

Sentencing Birch on Friday, Judge Laurence Marshall said the former nightwatchman had “grossly abused” his position and ruined the lives of his victims.

But he told the pensioner, who sat in the dock in a wheelchair, that he was receiving a reduced prison sentence because of his age and also because of his physical and mental health.

“The trial required young men whose lives had been shattered by what you and your co-defendant did to confide in public their most horrible memories,” said the judge.

“By your actions, you caused these boys to abscond where they could only subsist by reverting to crime.

Dad’s Heartbreak as Jailed Paedophile Is Finally Unmasked

A FATHER whose two daughters were subjected to horrific sexual abuse told yesterday how his family had been “touched by evil”.

Pervert Daniel Walshe was jailed for seven-and-a-half years for abusing three children.

The heartbroken father of two of the victims, spoke out after Walshe, himself a father of two, was sentenced.

He said: “We have cried so much that there are no tears left.

“We were devastated when our daughters told of the disgusting litany of abuse that this self-confessed paedophile subjected them to over a protracted period of time.”

His abuse only emerged when one of the victims, who was aged five at the time, told her mother.

The victims’ father, who cannot be named, said: “The whole process has been a painful one and has taken its toll on us, both emotionally and physically.

“At this stage we want to move on with our lives and allow our children to continue to develop within as normal an environment as possible.”

He said his family had travelled “an unimaginable journey of pain, grief and despair”.

The father added: “We always believed in the innate goodness of human beings.

“We have lived by the ethic that we would do no harm to others but would actively do good. Perhaps we were naive, I don’t know.”

Victim impact reports have shown that both girls, although affected, are now doing well.

But they stated this was in no way related to anything Walshe had done.

Their father added: “The only reason that they are doing well is because my wife and I have focussed all of our strength and energy into stabilising their world, with the result that we have shouldered their pain and anguish.

“We did nothing to warrant this. We did not hurt anyone.

“But God knows there have been many times when we wanted to inflict physical damage on the abuser of our children. We are not like him, though.”

Dundalk Circuit Court heard how Walshe pleaded guilty to sexually abusing the three girls.

A detective described the offences which occurred between May 1997 and September 2000 as “horrific”.

One of the girls was abused for three years from the time she was five.

The abuse stopped when the girl refused to be enticed into Walshe’s home.

His second victim, a sister of the first girl, was aged four when she was lured by Walshe.

A mask was placed over her eyes and she was abused.

When the third victim, who was aged five at the time, was tempted into the house on the promise of sweets, the door was locked and then she was masked and abused.

Pervert Walshe also took pictures of this victim.

The young girl was allowed out of the house when she said she did not want to play any more and she alerted her mother.

Det Garda Maureen McFadden, who prepared reports on the victims, told the court that the three girls had been traumatised by what happened and she was concerned at the long-term effect of the abuse.

She said: “Their childhood innocence has been destroyed.”

The court heard the defendant was now split up from his own family.

A defence barrister told the court his client had a hard upbringing and this had moulded him into a loner and a depressed character with a drink dependency.

Walshe had been attending the Granada Institute which treats people with sexual problems.

And his counsel told the court Walshe was considered unlikely to re-offend.

Judge Raymond Groarke said the defendant had gone about the offences in a cold, careful, cunning and calculated way.

Last Thursday he imposed a nine-year jail term but suspended the final 18 months.

He rejected an application that Walshe’s name remain confidential but prohibited publication of any details which would identify his victims or their families.

Pervert ‘who invited teenagers to his house’ avoids jail for sexually assaulting 15-year-old girl

A FATHER has avoided jail after he touched up a teenager he had invited to his home.

Liam Ryan, aged 45, was arrested when his 15-year-old victim raised the alarm after she was sexually assaulted while she slept, Bolton Crown Court heard.

Michael Goldwater, prosecuting, said Ryan, from Dean Court, Bolton, was in the habit of inviting teenagers to his home and supplying them with alcohol.

The victim, who cannot be named for legal reasons, was with a group who went to Ryan’s home on October 26 last year.

The teenagers were given a litre bottle of vodka, an alco-pop and flavoured shots, the court heard yesterday.

The victim fell asleep and Ryan carried her upstairs to a spare bedroom.

All but one of the other teenagers left the home to get alcohol at another address.

Mr Goldwater said about an hour after the group left, Ryan went into the room where the girl was sleeping and undressed her, keeping her underwear on and putting her pyjamas on top.

He then massaged her shoulders and upper back and touched her inappropriately.

Mr Goldwater said: “She grabbed his hands and kept them away. He then watched at the end of the bed, fiddled with his trousers, dropped them to the floor and left the room.”

Ryan, who has a previous conviction for a dishonesty-related crime, was arrested the next day.

Judge Davies, sentencing, said: “The sentencing guidelines mean I can’t impose a sentence much more than 18 months imprisonment.

“After nine months you would be released and would have received no help in custody and you’d be without the benefit of any help outside custody.

“The principle aim is to make sure you do not commit such offences again.

“The only way that can be done is if you go on an appropriate sex offenders programme and are made subject to a sexual offences prevention order.

“If there are any breaches you will go to prison, there won’t be any second chances.”

Ryan admitted one count of sexually assaulting a child on the day he was due to stand trial.

He was sentenced to a three-year community order where he will complete a sexual offenders’ programme, he will be subject to a 10-year sexual offences prevention order, his name will be placed on a list of barred persons and he must notify police of where he is living for seven years.

Drug addict jailed for killing child

A heroin addict who murdered his girlfriend’s three-year-old daughter has been jailed for life.

Adrian Jones, from Wolverhampton, waited until his girlfriend Nicola Saunders was out working as a prostitute, before he abused and killed Terri Saunders.

Birmingham Crown Court heard on Tuesday, the youngster had suffered more than 100 injuries to her body including extensive internal injuries.

Jailing the 30-year-old for life, with a recommendation he serve at least 23 years, Mr Justice Astill, said: “It is a story of cruelty and depravity and hardly recognisable of human behaviour.

“In my judgement, it is important that the public do know what a life sentence is.”

Saunders was jailed for three years after she admitted child neglect.

The youngster had more than 100 bruises on her body and injuries including a broken collar bone, torn abdomen, cuts and bruises to her face, neck and head and burns to the hands and head.

Terri was seen by doctors and social services five weeks before her tragic death at home in Stafford Road, Fordhouses. But excuses given by the Wolverhampton mother were accepted by the doctor and social workers and she was sent home

Mr Justice Astill told her she had turned a “blind eye” to her daughter’s suffering.

“Your priority in life was to get the next heroin fix.

“On the night Terri died, bearing in mind the treatment she received, Terri asked you to stay in and not leave her alone with the man that killed her.”

A post-mortem examination revealed Terri died from a brain haemorrhage, although there was also evidence of abdominal injuries consistent with a beating.

Shop worker jailed for sex attacks on girls

A Worcestershire supermarket worker was jailed for three years yesterday for sex attacks on two young girls.

Paul Rowland (31), of Hightrees Close, Batchley, Redditch, committed some offences in a house and others in a caravan.

He confessed to police he “fancied” one girl and did not see her as a child, Mr Adam Farrer, prosecuting, told Worcester Crown Court.

Rowland admitted four counts of indecent assault and six of indecency with children between 1989 and 1997.

Mr Farrer said the former Tesco nightshift worker was arrested on the day one victim told a teacher about the sex abuse.

He admitted touching, getting the girls to fondle him and even confessed to showing one of them a porn movie

Mr Andrew Lockhart, defending, said he stopped the abuse when he realised he was doing wrong.

His wife was standing by him and he had expressed deep remorse. He had not displayed violence or made threats to the girls, said Mr Lockhart.

Judge Andrew Geddes ordered that Rowland should be registered as a sex offender for life.

He said Rowland had taken advantage of young girls to commit and said the victims’ ages and the time span of the abuse were aggravating features in the case.

Babysitter jailed for child knife attack

A former nurse who held a knife to the throat of a six-year-old boy he was looking after has been jailed for two years.

Lee Mugliston, 35, from Ely in Cardiff, was also convicted of assaulting the child’s four-year-old brother.

Mugliston had been babysitting the children at the time of the incidents.

He was found guilty of one charge of wounding with intent and one of cruelty to a child at Cardiff Crown Court.

Prosecutor Richard Twomlow told the court: “Mugliston has ill-treated both of the children on occasions since November 2001.

“But these incidents only came to light after June, when the four-year-old child was injured,” he said.

The court heard how neighbours saw the Mugliston pick up the younger of the two boys by his neck and drop him onto the pavement outside the family home.

“The boy tried to run away but halfway across the street the defendant caught up with him,” said Mr Twomlow.

“He violently slapped him across the back of the head.

“He was knocked off his feet and fell to the floor screaming and crying.

“The defendant struck him again before pushing him into a gate.

“He then opened the front door and pushed the boy inside,” he said.

He added that a passing driver had heard Mugliston tell the child: “Get in there, I’m going to batter you.”

“Neighbours heard shouting and screaming and banging from inside the house and called the child’s mother,” said Mr Twomlow.

“One knocked the front door to ask Mugliston what was happening.

“He was frothing at the mouth and his eyes were bulging.

“The mother rushed home to find the boy with a wound to his forehead which required three stitches,” added Mr Twomlow.

During the trial, the older child, who cannot be named to protect his identity, gave evidence via a video link.

He said: “I don’t like Lee because he hits me and kicks me and I don’t know why.

“Once he held a knife to my throat when I was getting ready for bed. It was a sharp knife,” he said.

Bob Hawkins, defending said: “The defendant still denies what has happened.

“The sadness and irony is that he has spent part of his working life as a nurse helping other people,” he added.

Judge Isabel Parry told the defendant: “You have no idea how to handle vulnerable children appropriately – you are a man who is prone to display violent behaviour towards young children.

“You continue to deny all responsibility for the behaviour of which the jury has found you guilty,” she added.

JAILED PERVERT GETS CHARITY CHILD PICS

A CONVICTED paedophile was sent pictures of youngsters by a children’s charity he sponsored from his secure unit.

Drunken pervert Geoffrey Strike, 59, donated £150 a month for nine months to the global charity World Vision which aims to stop child poverty and abuse. In return, he received images and stickers of children with which he decorated the walls of his rehabilitation unit.

It is claimed unit staff were aware of his sponsorship but did nothing to stop it. Letters from World Vision to Strike were marked with his membership number and the note “staff to look at this”.

It was only when Strike halted his membership last month that the pictures stopped arriving. A source told the Mirror: “A lot of staff were unhappy this was going on and that apparently nothing was done.

“When mail comes to the unit, it is supposed to be vetted. If people know someone with Strike’s history is getting pictures of children then something is seriously wrong.”

Strike – who has a shocking record of assaults on youngsters – is locked up in Charles House, Salford, Greater Manchester.

Craegmoor Healthcare, which runs the unit, said: “In the interests of confidentiality, it is not our policy to comment on individuals.

“We have looked into these concerns and taken appropriate action.”

World Vision was unaware of Strike’s fantasies. A calendar sent to him contained images of smiling boys and girls for nearly every month.

Sharon McLeod, Head of Supporter Care, told him in a letter: “I just wanted to say ‘thank you’.

“My hope is that it will bring to life how much you as a child sponsor are changing the world for children just like the ones shown on the pictures.”

Former soldier Strike indecently assaulted a boy of six in 1975. He admitted he felt no shame.

In 1983, he was sectioned under the Mental Health Act. Two years later, he was jailed for three months at Bolton for assaulting a girl of 10.

In 1991, Strike was convicted of gross indecency on a boy. He was jailed again for six months in 1994 for threatening police with a sword before being moved to a secure unit.

Despite his record, he has been allowed out of the unit without escort.

Strike went AWOL for five weeks in August. He was found in a tent near a playground with a tub of vaseline, 300 cigarettes and a bottle of alcopop.

He is still allowed out of the unit on escorted leave.

World Vision said: “Our procedures are designed to prevent misuse of the sponsorship programme.”

Jailed boss wins cut in sex attack sentence

Kellar jailed for sexually abusing young children

A BUSINESSMAN jailed for a range of sex offences against young girls has had his sentence cut on appeal.

Russell Kellar, 49, of Church Street, Southport, was jailed for four years at Chester crown court last March after allegations that he had subjected two girls to a campaign of abuse.

Kellar, who was well known in the town for his charity work, had admitted nine counts of indecent assault on a female, four of gross indecency with a child, and one of sexual assault on a girl under 13.

Kellar jailed for sexually abusing young children

MACCLESFIELD businessman Russell Kellar has been jailed for four years after admitting a range of sexual offences against young girls.

Kellar, 49, was sentenced to four years behind bars and four years of rehabilitation when he appeared at Chester Crown Court yesterday (Tuesday).

He must also sign on to the Sex Offenders’ Register for life and is not allowed to work with children.

Judge Roger Dutton said Kellar was well-known in the town for his charity and community work, and this showed he had positive attributes.

But, he told the defendant: “The sad fact remains that there is hidden in part of your character the desire and need to act inappropriately with young children.”

The father-of-four, who runs a menswear shop on Chestergate, pleaded guilty to abusing two young girls. The offending began in the late Seventies. The first girl was just eight years old when 19-year-old Kellar started to grope her. He continued abusing her until the early Eighties.

There was then a break of more than two decades before Kellar began abusing the other girl in 2001, when she was also eight-years-old. The abuse took place in several locations, including his caravan in Abersoch, and he told her that she would be sent to jail if she told anyone.

Kellar, who wore a pin-stripe suit and red tie in the dock and whose family were in court, was charged with 16 offences in all. He pleaded not guilty to two charges of gross indecency with one girl under the age of ten, but admitted two offences of gross indecency with her while she was under the age of 16.

He also pleaded guilty to another two offences of gross indecency with the second girl, while she was under the age of ten.

He also admitted nine offences of indecent assault on both girls and one count of sexual assault on the second girl while she was under 13.

Sean Brogan, counsel for the defence, said this was a case of a good man who had done bad things.

“Perhaps this is one of these unusual cases for the court, given his, well, frankly startling admissions, given his guilty pleas, there is another way forward other than custody.”

He said Kellar had already been punished immeasurably by the shame and embarrassment of having to tell his family and the family itself had been punished by the publicity surrounding the case. He said they would now all have to leave the town.

But Judge Roger Dutton said he had used the girls for his own sexual gratification and the case demanded a sentence of immediate custody.

Kellar’s Chestergate store is due to close within the next two weeks and his £600,000 Park Lane home is on the market.

A man flashed at schoolgirls as they walked to their mosque, a court heard.

Farman Saeed exposed his genitals to the horrified 14-year-olds as they headed to the Abu Bkr Mosque near to his Paddock home.

The 31-year-old pleaded guilty to three charges of exposure when he appeared before Kirklees Magistrates’ Court.

He was warned that custody is an option when he is sentenced next month.

Vanessa Jones, prosecuting, said that the offences took place over an eight-month period.

She told the court that the offences were aggravated by the fact that they were witnessed by girls going to the mosque two doors away from Saeed’s home in Church Street.

Mrs Jones said: “One of the girls who gave a statement said that a few times going to the mosque she heard a banging at the window of his (Saeed’s) flat.

“She looked over to the window and saw that he was naked.

“He raised his leg up and she could see his genitals.”

Mrs Jones said that on another occasion the girl was walking past with a friend when again banging was heard coming from his flat.

This time the girls saw him stood at the front door without his clothes on.

On one day they witnessed him sat in the entrance of his property, cross-legged and completely naked.

Mrs Jones said that the girls were very embarrassed by what they witnessed.

Saeed’s solicitor Emily Price said that her client had a difficult and complicated history and a psychiatric report on him had previously been obtained.

District Judge Michael Fanning ordered a full report on Saeed before his sentencing on August 27.

He told him that he was not ruling out custody or committing him to crown court for sentence.

Because of his convictions Saeed has now been placed on the sex offenders’ register.

Easter Ross youth on Sex Offenders Register for having sex with under-age girls

AN Easter Ross youth was sentenced at Inverness Sheriff Court today to 12 months in a young offenders institution for having sex with two underage girls.

Alexander Mitchell, who is now 20, was 19 years of age at the time of the offences involving girls aged 14 and 15.

His solicitor Aileen Macinnes asked Sheriff David Sutherland to deal with the case by means of a community based sentence rather than custody.

But Sheriff Sutherland told Mitchell, formerly of Balintore but whose new address was given in court as Harbour View, Invergordon, they were serious offences.

“Young girls ought to be protected. I don’t consider that I can deal with this case other than by a custodial sentence.”

Sentence had been deferred for criminal justice social work reports.

Mitchell previously admitted having unlawful sex with the 14 year-old at an address in Milton between May 1 and June 1 last year, and the 15 year-old in a lane beside Alness Parish Church on May 4, 2013.

Depute fiscal Roderick Urquhart told the court previously the incident involving the 14 year-old followed a gathering of a group of youths who had gone to a house in Milton and played DVDs. About 10pm some of the youngsters moved upstairs to a bedroom and Mitchell went into another bedroom with the 14 year-old, where they had sex on a sofa bed.

The following morning depute fiscal Roderick Urquhart Mitchell told the girl’s friend that the 14 year-old was ”not a virgin any more”. The 14 year-old also told her friend in the kitchen she had sex with Mitchell.

Friends advised her that Mitchell had a sexually transmitted disease (STD) and told her to get checked out. Eventually social workers and the police were informed.

Mr Urquhart said the incident involving the 15-year-old followed a party which had been raided by police because of under-age drinking. Youths left the house and the 15-year-old and Mitchell were with two other youngsters.

Mr Urquhart said this girl was six weeks short of her 16th birthday.

Mitchell and the girl were seen kissing by their friends who left to go to a bus stop near the church.

Mitchell then had sex with the girl before joining the others.

At her home the 15-year-old told a girl she had sex with Mitchell. He later denied having sex with both girls when interviewed by police.

Ms Macinnes said today that both offences occurred while he was under the influence of alcohol.

“There is no suggestion he thought out what he was going to do and he merely acted in a situation due to his consumption of alcohol.”

She added that the 20-year-old had no significant record of offending and had “‘showed a degree of immaturity”.

Mitchell was also placed on the Sex Offenders Register.

Man had thousands of indecent child images

A REDDITCH man has been spared jail and given a chance to get help after he admitted having thousands of child abuse pictures.

Terence Cox, aged 62, pleaded guilty to having more than 4,000 indecent images on his computer when police raided his home in Fulbrook Close, Redditch, on October 11, 2012.

These included 3,657 at level one, the least serious, and 23 at level four but none at level five, the most serious. He also had a hundred moving images of children and 210 extreme porn pictures, Christopher Lester, prosecuting, told Worcester Crown Court.

Martin Butterworh, defending, said Cox had been jailed for 18 months for a similar offence in 2003 and had been given no treatment. He now admitted he got a sexual satisfaction from viewing images of children and was prepared to get help. He said Cox was on pension credit and his wife was in poor health.

Judge Michael Cullum said the offences were serious because the images featured real children being abused and having their lives ruined.

“You are the market for these pictures. It is your fault. You bear a heavy responsibility,” he told Cox.

He said he was prepared to allow Cox his liberty to work on his problem as it would do more good than a prison sentence. He was given a three year community order with supervision and the requirement to complete the sex offenders group work programme.

He was also given a sexual offences prevention order restricting his computer access for 10 years and ordered to register as a sex offender for five years. He was also ordered to pay £500 towards costs.

Church Hill man charged with indecent photos

An already convicted paedophile has been charged with making more than 3,500 indecent photographs of a child.

Terrence Kenneth Cox, of Fulbrook Close, appeared at Redditch Magistrates’ Court on Tuesday (March 11) to face charges including making 3,693 indecent level one photographs of a child between May 27, 2011 and September 29, 2012.

The 62-year-old also faced three charges of possessing 230 level two, nine level three and 39 level four indecent images of a child between May 27, 2011 and September 29, 2012. Images are graded for severity from one to five with one being the lowest.

Cox is also accused of having banned images of a child and 210 extreme pornographic movies involving animals on October 11, 2012.

Cox entered no plea and was released on conditional bail to appear at Worcester Crown Court on June 30.

Magistrates told him he could not contact anyone under the age of 17 unless supervised by someone who had been authorised by Children’s Services.

Men guilty of child abuse images offences

Two men from Redditch have pleaded guilty to possessing indecent images of children.

Paul Donnelly, from Evesham Mews, and Terrence Kenneth Cox, of Mercot Close, were arrested by West Mercia Police after a tip-off from detectives working on a national level.

Police found indecent images of children on computers at both men’s homes.

Cox was also found to have indecent images on CD-Roms and on a terminal at his workplace.

A police spokesman said 84 people have been arrested in Herefordshire, Worcestershire and Shropshire during four months of investigations.

Inquiries are still continuing and some computer equipment is yet to be examined.

The operation is a major police investigation into the activities of suspected paedophiles.

Both men will be sentenced on 9 April.

Ambulance driver pleads guilty to child sexual abuse charges involving girls including a 12 yr old

AN ambulance driver has been locked up after admitting sexually abusing a young girl and bombarding another 12-year-old from Burton with explicit text messages.

Jaimie Bent sent around 4,600 texts to the 12-year-old and met up with her several times at Shobnall Park.

After he was arrested, his other victim came forward and told police how Bent had ‘groomed’ her and touched her inappropriately.

Judge Michael Challinor remanded Bent in custody for reports directed at whether he is a danger to children.

The judge told him: “A sentence of imprisonment is absolutely inevitable.”

Bent, 49, of Barton Marina, Barton under Needwood, initially denied all offences but, on the second day of his trial, changed his pleas on two charges before the girls were called to give evidence.

He admitted one specimen charge of sexual activity with a 13-year-old and one charge of inciting a 12-year-old to sexual activity.

In a basis of plea, Bent said he had kissed and hugged the first girl on a few occasions and touched her inappropriately.

Regarding the girl from Burton, Bent said he accepted sending her the text messages but said there had been no sexual activity between them.

Nick Tatlow, prosecuting at Stafford Crown Court, told the jury the text messages were only discovered when the girl broke her mobile phone and her elder sister took it to be repaired.

After Bent was arrested and bailed by the police, another girl came forward in January this year.

She said he had been ‘grooming’ her since the age of 12 and went on to touch her inappropriately.

On Bent’s computer were 96 emails between him and the girl. Mr Tatlow said the messages were not overtly sexual in nature, but intimate in content.

He said: “They were going to set up home together, have children and marry.”

Bent also wrote that he was going to leave his partner for the girl.

Bent will be sentenced at a later date and his barrister Darron Whitehead applied for his client to be remanded on bail until then.

But Judge Challinor, refusing bail, said: “The matter that concerns me is that in the past he has attempted to take his own life and he is particularly vulnerable at the moment, and a sentence of imprisonment is absolutely inevitable.”

Sealand man had sex with girl, 14

A MAN who had sex with a 14-year-old girl was told by a judge he was a high risk to young girls.

Adam Challinor, 23, who has mental health problems and a personality disorder, also indecently assaulted a teenage boy and exposed himself to him while out fishing.

His case was described by a judge at Mold Crown Court as “worrying”.

“It is worrying because you clearly know no boundaries as far as appropriate sexual behaviour is concerned,” Judge Niclas Parry told him.

In particular, he was said to be a high risk to young girls.

The judge said the most serious offences occurred when he was 19 or 20 and involved with a vulnerable girl aged 13.

He had unprotected sex with her when she was 14 and the girl had said that at times she felt pressured to say yes.

It was an aggravating feature that there was a significant age difference physically and he knew what he was doing was wrong.

The young victim had agreed to everything, but one of the reasons the law existed was to protect young females from themselves.

Then in August last year he bullied a 13-year-old boy, exposed himself and touched his bottom five times.

But Challinor, who had pleaded guilty, had his own vulnerabilities. He had learning difficulties and had a mental age of somewhere between nine and 12, which meant the disparity in age feature was less aggravating.

“You have very little understanding of the gravity of what you have done,” Mr Parry told him.

“Unless that changes, the public will remain at risk.

“That risk can only be reduced if you are made subject to intensive intervention.”

He had already spent some time in custody and a prison sentence at this stage would mean that he would be released back into the community without any treatment.

Challinor, of Sealand Court, Sealand, received a 14-month prison sentence, suspended for two years.

He was placed on supervision for two years under which he will receive mental health treatment in the community. He was placed on the sex register for 10 years and a 10 year SOPO – sexual offences prevention order – was also made.

Challinor admitted four charges of sexual activity with the girl, sexual assault on the boy, and indecent exposure.

Sion ap Mihangel, prosecuting, said Challinor accepted having sex with the girl and told police it was “up to her really”.

John Hedgecoe, defending, said reports on his client showed he had a very young mental age and would benefit from the help of the community mental health team.

“What he needs, as soon as possible, is further assessment from the mental health team. It is hoped he can be assisted,” he said.

This is the face of leering paedophile John Carvin looking out of a window just yards from a playground.

The 45-year-old dodged prison last month for sexually assaulting his brother’s stepdaughter when she was seven.

But his presence was only made widely known to residents in the Holywell neighbourhood of Swords, Co Dublin, after his house was daubed with graffiti at the weekend that read “paedophile”.

Disgusted locals have now started a campaign to kick him out, staging a protest on Monday evening and last night outside his house.

The pictures show that public pressure may be getting to the sex offender as he appears to be considering fortifying his home which is just across from a popular playground.

Carvin, who has not been seen outside his house since Monday, even refused to leave the property when a tradesman called to the door, instead speaking to him through the window.

The worker appeared to be checking the locks on the pervert’s windows, one of which seemed to be broken, as Carvin looked on wearing a vest.

A Garda spokesman said officers are investigating an incident of criminal damage – a broken window – which took place in the area at around 10pm on Monday.

When the Irish Mirror called to Carvin’s home yesterday, he didn’t even step outside his hall door to speak to our reporter.

He only opened it long enough to say: “I’m not making any comments, none whatsoever.”

Carvin now faces an uphill battle to stay in his home with locals set to step up their campaign to get rid of him – planning even more demonstrations outside the house.

One resident, who wanted to be identified only as Michael, said: “He’ll move on to another area now, he has to.

“I think most people didn’t know until his house was sprayed and the protest helped raise awareness.

“There are more protests planned now, there will be people protesting outside his house every day. He went into a pub the other day and he was recognised and thrown out, he’s becoming blacklisted in the area.

“There are kids going back to school in a few weeks, I’d say people will be spreading the word.

“I’m a father, I have four young kids myself and I wouldn’t bring my kids near the playground.

“People are mad about the fact he didn’t go to jail. He wasn’t properly punished, I think it is a disgrace. There will be more protests now as word spreads.”

Carvin’s victim refused to meet with him after he was found guilty of sexual assault.On the night of the abuse almost 14 years ago, he climbed into the seven-year-old’s bed, kissing and rubbing her.

The sicko left but then returned shortly afterwards, making the girl perform a sexual act.

Imposing his sentence at Dublin Circuit Criminal Court last month, the judge said the abuse was “at the lower end of the scale” and added the offence seemed to be a one-off.Carvin was handed a three-year suspended sentence.

Family members run from courtroom as paedophile gets fully suspended sentence

A man who sexually abused a family member has avoided a jail sentence after his victim refused to meet him under the Restorative Justice Programme.

Earlier this month Judge Patrick McCartan asked the victim to consider meeting John Carvin (45) under programme before he passes sentence.

The man was convicted last April of sexually assaulting the then seven year old after climbing into her bed late at night.

The court that the man was sleeping in the room beside the girl on the night of the abuse. During the night he climbed into her bed and began kissing and rubbing her.

He left but returned shortly afterwards and made her masturbate him before telling her “to get on top.” She refused and the man fell asleep. He was later discovered in the bed by another family member who told him to get out.

He was acquitted of sexually assaulting her on two other occasions.

At the previous sentence hearing, the judge said he was suggesting the programme because “this is a close family that is badly fractured by what has occurred.

“If there is a prospect that this can be put right then this might well be an option that is worth exploring.”

The court heard from Fiona Murphy BL, prosecuting, that the victim does not want to meet with Carvin.

The victim also waived her right to anonymity so he can be publicly named.

Carvin initially refused to accept the jury’s verdict but his counsel said that he has changed his mind.

Judge McCartan said it was understand that the victim does not want to meet Carvin as it would involve her reliving the abuse “in very challenging circumstances.”

He said he had investigated the programme as a possibility “in the hope that some reparation of the family relationship might be achieved.”

The Restorative Justice Programme, which is run by the Probation Service, involves parties meeting in a supervised setting to discuss the effects a crime had on the victim.

Imposing sentence, the judge noted that Carvin forced the now 20-year-old victim to go through a trial process by refusing to admit his guilt.

He also observed that he “challenged very strongly” the victim’s version of events, effectively saying she was lying.

However he said that the abuse was at the lower end of the scale and Carvin has belatedly admitted his guilt. He imposed a three year sentence suspended in full for three years.

There were emotional scenes from the victim’s supporters and one of her family members ran out of the courtroom as the non-custodial sentence was handed down.

Carvin of Holywell Crescent, Swords pleaded not guilty at Dublin Circuit Criminal Court to three instances of sexual assault on the child in Dublin on dates between October 2000 and February 2001.

In a victim impact report the woman said that she suffered considerable stress and anxiety as the trial approached.

She said she had nightmares about the abuse and the trial, including dreaming that the judge would shout at her and tell her that she was lying.

Defence counsel Caroline Biggs SC said that her client married in 2010 and has the support of his wife. She said he has a good work record and may keep his job depending on whether the judge sends him to prison.

Vile paedophile owned kids’ nursery

A vile paedophile who attacked victims as young as two years old has been locked away for life.

Children’s nursery owner Daniel Lynch, 27, of Taplow, committed a series of sickening sex attacks on young children over a three-year period.

Lynch owns two children’s day nurseries, one for children aged from three months to two years and another for two to fives.

He also recorded graphic pictures of his campaign of physical abuse with spy cameras set up at his home, some of which included the highest category of seriousness.

Lynch pleaded guity last November to 39 counts of sexual offences against children including sexual assault of a child under 13, assault on a child under 13 by penetration, and taking and making indecent photographs and pseudo-photographs of children.

Sentencing him to an indeterminate life sentence at Aylesbury Crown Court yesterday, Judge Christopher Tyrer, said: “The damage you have done to any of these children is incalculable and your dangerousness to the public is inevitable.”

The sentence means Lynch will spend at least the next three years in jail before he can go before a parole board.

Lynch has been placed on the Sex Offenders’ Register and is banned from contacting the children or being near children under 16 years without their parents being present. He is also not allowed to download any pornographic material from the internet.

Speaking outside the court, one of the child victim’s mothers, who cannot be named, said: “He preyed on loads of kids and groomed them. He is a very manipulative man. I could not bear to look at him in the dock, he is very sick and twisted.”

Bristol paedophile and rapist who abused two girls for decades jailed for 17 years

A paedophile and rapist from Bristol has been put behind bars for 17 years after committing numerous offences against two children over a decade.

Investigating officer, DS Emma George, of the Operation Bluestone team based in Bristol, said: “I hope the lengthy sentence given in this case acts as deterrent to others.”

Michael Jenkins, the 38-year-old, of Dunster Road, Knowle West was convicted of one rape, three sexual assaults and one indecent assault, following a trial at Bristol Crown Court.

He had previously admitted three sexual assaults, two counts of sexual activity with a child, 12 counts of making/taking an indecent photograph of a child, possessing an extreme pornographic image and one count of inciting a child to engage in sexual activity.

The jury heard how, from 2003, Jenkins repeatedly abused two girls who were aged between eight and 14.

DS Emma George said: “Michael Jenkins is a serial offender who put himself in situations where he could have easy access to young victims.

“One of his victims took the very brave step of contacting police in February, 2013, to report sexual offences committed against her as a child. A second victim came forward a short time later.

“Further to the abuse, Jenkins also used the internet to pursue his criminal interest and was found to have contacted an 11-year-old girl from Sheffield through Skype with the intention of trying to persuade her to visit him in Bristol for sex.

“I would like to praise all the victims in this case for disclosing the abuse they suffered. It can never be underestimated how hard it is for people to talk about these types of offences, as it often prompts very complex emotions and painful memories.

“The most important thing is that victims are believed, supported and protected and offenders like Michael Jenkins are brought to justice.

“I hope the lengthy sentence given in this case acts as deterrent to others.”

Pervert facing jail after abusing two young girls in 1970s

A PAEDOPHILE has been warned he is likely to go to jail after he admitted historic sex offences against two girls.

Robert Midgley, aged 61, of Bromwich Street, The Haulgh, admitted four counts of indecent assault on girls. The crimes took place in the 1970s.

The charges relate to two girls, one who was aged between eight and 10 during the abuse and one who was aged between 10 and 11.

The charges are specimen counts in which the abuse occurred more than once.

Midgley pleaded guilty on the day of the trial, but denied one of the charges, which will lie on file and over which no further action will be taken.

Judge Peter Davies adjourned the case until September 5 to allow for a pre-sentence report to be prepared.

Judge Davies, at Bolton Crown Court, said: “Robert Midgley, you will be sentenced on September 5.

“In cases like these the overwhelming likelihood is one of custody.”

Serial offender jailed after lying to new partner about past

A SERIAL offender hid his murky past after moving in with a partner he met via an Internet dating site.

David Roberts told the mother-of-two that he had been jailed for violence – in reality he had been locked up for ten years in 2004 for sexually abusing a child.

However, the woman spoke to police about her mounting suspicions after he asked for a photo of her daughter in a prom outfit and had been “over-enthusiastic” in wanting to decorate her room.

The police then discovered that he had breached his sex offenders’ licence without telling them of his change of address and that two teenage girls were living there, said prosecutor Ceri Harrison at Southampton Crown Court.

Roberts, of Jessamine Road, Shirley Warren, Southampton, admitted the breach and was jailed for 12 months.

Judge Derwin Hope heard that Roberts had committed 65 previous offences.

In mitigation, Tim Dracass said there was no suggestion of sexual grooming or the children being harmed.
